AstraZeneca said Tuesday it will pay $1.3 billion to settle U. S. lawsuits related to an over-the-counter drug maker's use of a generic version of its blockbuster blockbuster blockbuster drug Nexium.
The federal government is considering whether to sue the drugmaker for alleged violations of the Federal Trade Commission's anti-trust act.

D’Anmodeo, United States Attorney in the District of New Jersey, in a criminal complaint. "This action by AstraZeneca is clearly an attempt to force the manufacturer to pay a damages award to the plaintiffs for conduct that was not in accordance with applicable law."
The Nexium lawsuit is AstraZeneca's second legal challenge to the company's marketing of the drug.
In March, AstraZeneca brought a class-action suit against the company, alleging that the company knew or should have known of AstraZeneca's marketing of Nexium, a prescription drug for chronic pain.
The company said in a statement that it is in discussions with the federal government to decide whether to pursue litigation regarding its conduct.
Food and Drug Administration said on its Web site that it will monitor the Nexium lawsuits and will take all legal action.
The company said it is reviewing all its options and will cooperate with the FDA's investigation and regulatory authority in resolving the cases.
Romeo Diaz-Acampo, executive vice president and general counsel of AstraZeneca, said in a statement that his company will pay up to $2.9 billion to resolve the Nexium lawsuits."This settlement should allow AstraZeneca to continue to focus on the full scope of its marketing and development programs while avoiding significant losses in the future," he said.
The company, which said it would pay $1.3 billion to resolve the Nexium lawsuits, is the biggest U. maker of a generic drug to date.
Cindy Anderson-Zook, general counsel of the California-based company, said in a statement that the Nexium injury is "not a direct result of Nexium or other related generic drugs."D'Anmodeo said in a telephone interview that the Nexium lawsuit is "not an instance of an allegation or settlement of a class-action," and is "not an example of a class action. It is an example of a class action."In November, the U. District Court for the District of New Jersey granted AstraZeneca's motion for summary judgment in two Nexium suits.
"By virtue of the fact that AstraZeneca's conduct occurred prior to the date of filing, and the fact that it is not a current or past patent litigation, we are not able to determine whether AstraZeneca's conduct at the time it filed its Nexium claim, or whether it was later determined by the court that it did not have a valid patent," said the district court judge in the cases.
The Nexium suits are AstraZeneca's second legal challenge to the company's marketing of the drug, which is still in the works.
In March, the federal government also reached a settlement with AstraZeneca regarding a Nexium lawsuit and settled the case for $1.3 billion, according to a criminal complaint.
AstraZeneca is seeking to recover $25.1 million in punitive damages, a $10.8 million award for damage to the plaintiff's health, and an additional $6.
